In the last few years, European firms have been keen to take advantage of the possibility of organising long-term assignments for their employees under current EU law.
Our company VAV SYNERGY also works according to this system and provides services for the legal employment of CIS citizens through official delegation (business trips) to EU countries. The specifics of this process, in turn, are regulated by the current Directive 96/71/EC of the European Parliament and of the Council of 16 December 1996 concerning the posting of workers in the framework of the provision of services.
Candidates are first registered at our Polish company, whose legal registration can always be checked on the website of the Ministerstwo Sprawiedliwości https://ekrs.ms.gov.pl//. Then, under a subcontracting agreement, the employee is sent on a long-term business trip to one of the EU member states to carry out the work. And this is completely a legal way of doing it.
In order for an employee to be officially registered and seconded to another EU country, it is necessary to prepare all authorization documents and the A1 certificate (which we wrote about earlier) from a Polish company. It is possible to work legally only in the place and in the specializations for which the contractual agreements with the partner have been signed.
In addition, the company in Poland pays monthly taxes and insurance premiums for the delegated employee. This is confirmed by a statement from the tax office in Poland.
As a result, specialists on a valid Polish visa can legally work in any European country and employers can provide them with jobs without violating the legislation of the country in question. Such relations are regulated by contracts.
